The website accessible at www.algherodivers.comcan be used for browsing by any internet user seeking information about the activities of the Diving Center. To use our site for booking services that require a fee and/or to receive our services, the user must be at least 18 years old, or have reached the age of majority defined in their jurisdiction, and possess the legal authority, right, and freedom to enter into a binding agreement with these Terms. It is not allowed to use this website and/or receive the services provided if it is prohibited in your country or under any applicable law or regulation.

Main Commercial Conditions Offered to Customers

When you purchase a service through the site www.algherodivers.com, you agree to the following:

• You are responsible for reading the entire item/product/service listing before committing to buy it.

• You commit to entering into a legally binding contract for the purchase of an item/product/service when you commit to purchase and complete the checkout payment process.

The prices we charge for the use of our services/products are listed on the website.

​

We reserve the right to modify our prices for the products displayed at any time and to correct pricing errors that may inadvertently occur. Additional pricing and sales tax information is available in the various sections/pages of the price lists. (Diving Price List, Rental Price List, Course Price List)

Payment Methods

​

The accepted payment methods for purchases made to confirm bookings of services and activities through the sitewww.algherodivers.comare primarily:

​

• PAY BY LINK, a service offered through Banco di Sardegna - Gruppo BPER, which channels payments to the bank account of Guardia Grande srl through the use of the user's credit card.

• BANK TRANSFER/BONIFICO BANCARIO payable to Guardia Grande srl [ASK FOR IBAN], a copy of the receipt must be sent to amministrazione@algherodivers.com with the subject: ACTIVITY PAYMENT.

Right to Modify the Offer

​

We may, without notice, modify the services; stop providing the services or the features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason or no reason.

Warranties and Liability for Services and Products

​

Purchasing a service or product from those we offer entitles you to use it under the conditions established by the diving center and within the agreed times; in particular, we commit to guaranteeing the service barring force majeure that prevents the diving center from operating, such as: serious malfunctions of equipment or boats not dependent on our will, blockage of activities by the port concessionaire where the boat is moored, sudden limitations to activities imposed to safeguard public health and safety through ordinances or bans by authorities. In such cases, when the service is not usable, the customer is entitled to a refund of any amount paid. Should the center be able to provide the service using another facility, the customer will not have to pay any additional amount even if higher costs are incurred by the diving center. Should the customer refuse to use the same service through another facility due to logistical issues that the center cannot remedy free of charge for the customer, they will be entitled to a full refund of the amount paid.

Course Purchases

 

The customer who purchases a course is entitled to use it within one year from the purchase date or within 12 months from the purchase date. After this period, if the customer has not completed the training, a different arrangement must be agreed with the Diving Center.

​

Purchasing a course materializes with the customer paying for the teaching materials required and necessary for the purchased course. The teaching materials are the property of the trainee and can be used to complete the course at another diving center/diving school/instructor not directly associated with Guardia Grande srl.

​

Should the trainee decide to complete the course at another entity/diving school/instructor not associated with Guardia Grande srl, they will be required to pay Guardia Grande srl for the portion of the course provided and will be entitled to receive all documentation certifying the lessons conducted and the modules completed.

​

The course certification and the issuance of the certificate to the trainee will take place only upon full payment of the course and certification fees specified for each type of course or specialty.

​

Guardia Grande srl may refuse to certify the course participant who:

​

• Has not met the performance standards of all course skills or has not demonstrated having acquired the knowledge required for the relevant certification.

• Has not fully paid for the course and certification fees for the issuance of the certificate specified for each type of course or specialty.

​

Service Bookings

​

The booking of services provided by the Diving Center Alghero Divers - Guardia Grande srl is considered confirmed and binding for the Center only when a deposit has been paid by the customer.

​

The booking is not binding if a deposit has not been paid and the Center reserves the right to keep such spots available and potentially assign them to other customers without being obliged to notify. It is the customer's interest and sole responsibility to verify the actual availability of spots.

​

Cancellation Penalties

​

In case of a confirmed booking for which the customer has paid a deposit and fails to show up on the scheduled date and time for the booked activities, we will retain the deposit as compensation for the lost income, as follows:

​

• Retention of 100% of the deposit and request for the remaining amount payment if the customer does not show up without a justified reason and prevents the center from making the service available to other potential customers without informing the center by 12:00 PM of the day before the booking.

• Retention of 100% of the deposit paid without further expense if the customer is unable, for demonstrable reasons beyond their control, to notify the absence from the activities on the agreed date and time.

• Retention of 50% of the deposit paid without further expense if the customer fails to show up on the agreed date for the scheduled activities, having notified the center by 12:00 PM of the day before the agreed activity date, and if the customer is not available to reschedule the agreed activity to a later date.

Ownership of Logos and Trademarks​

 

The trademarks and the name ALGHERO DIVERS are the exclusive property of Guardia Grande srl, and any unauthorized use or exploitation is prohibited without authorization from Guardia Grande srl.

The site contains other trademarks and logos owned by other companies and professional associations, and their use is subject to the terms and conditions established by the respective owners.

Right to Modify Terms

​

Guardia Grande srl has the right to modify the terms and conditions provided in this list without notice, except the obligation to inform subscribers of existing contracts and obligations if such modifications may bring substantial changes.

​

Jurisdiction for Dispute Resolution

​

The jurisdiction for resolving any disputes is Sassari.
